What benefits are offered by the ‘save home’ decree in the draft?

The Casa Decree, a proposed initiative by Deputy Prime Minister and Minister of Infrastructure Matteo Salvini, is set to be discussed in the Council of Ministers. The decree’s primary objective is to rectify various building discrepancies and provide insights into housing requirements while promoting the restoration of existing structures and reducing land consumption.

The draft decree includes several provisions, including changes in building violations, simplified intended use processes, and a new type of free building intervention that involves outdoor awnings. One significant provision allows structures built during the Covid emergency for “health, welfare, and educational” purposes to remain operational under specific conditions. Additionally, individuals may alter the intended use of individual real estate units without needing additional works as long as they comply with sector regulations and municipal planning instruments.

On the sanctioning front, municipalities can arrange for the alienation of properties with illegal work, making the sale contingent on the removal of violations. This measure aims to simplify small irregularities within homes while preventing individuals responsible for abuses from participating in property disposal procedures.

While some government allies support the decree, others such as Forza Italia have presented alternative projects to allow for small amnesties. Opposition parties have criticized this provision as a disguised “amnesty.” However, overall, the decree seeks to streamline regulations, address housing needs, and promote the recovery of existing buildings without granting unlimited amnesties for building violations.
