In Clearcreek Twp, Ohio, a proposed zoning code amendment is being considered that would prohibit marijuana businesses from operating in the township. The resolution includes definitions and standards for medical and residential marijuana, as well as a ban on cannabis operators, cultivators, and processors in all zoning classifications. This aligns with state law definitions.
In November 2018, Ohio voters approved Issue 2, legalizing the growing, processing, selling, and use of recreational marijuana in the state. This made Ohio the 24th state to do so. Under the new law, adults 21 and over are allowed to possess up to 2.5 ounces of marijuana, grow up to six plants per person and 12 per household. Medical marijuana has also been legalized in Ohio since 2016.
Despite statewide approval of recreational marijuana, Clearcreek Twp. and 47 other local communities have enacted moratoriums on cannabis businesses, representing roughly 9% of the state’s population. Township Administrator Matt Clark stated that the trustees oppose marijuana-related businesses and are reflecting the wishes of their constituents based on results from the Warren County Board of Elections.
