Europe’s dominance in new network technology development is at risk

Essential patents are critical for implementing standards set by standardization organizations and ensuring the functioning of digital infrastructure and technologies like 5G and 6G. However, a recent proposal by the European Commission on essential patents has sparked controversy, with some arguing that non-EU patent holders will benefit the most.

While China currently holds a significant share of essential patents worldwide, European companies like Nokia and Ericsson also hold substantial numbers. Superpowers play a crucial role in shaping technology according to global standards to maintain their position at the forefront of technological advancements.

Investments in research and development are substantial, with companies like Nokia and Ericsson investing billions of euros in Europe alone. The benefits of the proposed system may be relatively low compared to company investments, and any decrease in patent royalty income could hinder future investments in technology like 5G and 6G.

Maintaining a leading position in 5G and 6G technology is crucial for Finland’s strategic autonomy and global competitiveness. A potential solution could be to reassess the proposal and limit protection to European SMEs initially intended to facilitate their access to technology protected by essential patents while restricting protection to European SMEs may help achieve this goal.
